Deputy arrested in wife assault: 'I'm ready to go to jail'

Earlier in the day, the arrest of Michael W. Stott, a 15 year-veteran assigned to the Volusia County Courthouse, was announced in a press release by Sheriff's spokesman Brandon Haught, that said he was off-duty at the time of the alleged battery.

The arrest report, however, is far-more detailed, in which Stott's wife, Rose M. Fernandez-Stott, told deputies he pushed her to the ground in their backyard, causing abrasions to her left knee and marks on her neck from being grabbed. Photos of the injuries were taken on scene. The wife said her husband accused her of being "flirtatious" with an unknown 22-year-old man at the party, where alcohol was being consumed.

Deputy Kyle Bainbridge wrote in his report of the 11:27 p.m. incident that the wife said her husband's actions were not his usual behavior and she was scared for her life, stating: "I don't want to die tonight."

But when pressed to complete a statement, she declined. An arrest, however, where there is evidence of domestic violence, requires responding law officers to make an arrest against the attacker. The charge against Stott is a misdemeanor, punishable by up to a year in jail, if convicted.

When the deputy was asked to explain the injuries to his wife, the arrest report states he told his fellow law enforcers: "She must have got that from (performing a sex act) on the guy."

Stott's mug shot was not available on Volusia County's jail database. Mug shots of law enforcement personnel are exempt from the public, if an officer arrested had previously signed a document staking claim to that document.

However, the arrested officer is not able to prevent media from taking a photo at subsequent court appearances or using photos taken or obtained under other circumstances.

Volusia County Sheriff Ben Johnson could not be reached for comment Sunday night and the spokesman said he would not reach out to him because of the holiday weekend. Johnson, however, has said on numerous occasions that he will not cover up any wrongdoing by any personnel under his command.
