Ormond Beach cops: Teen driver won't be charged in death of kid brother in crash after school

ORMOND BEACH, Fla. -- No criminal charges will be levied against the 18-year-old driver responsible for her kid brother's horrific death in what was to be a regular after school ride home.

"Ormond Beach Police traffic homicide investigators pored over all available evidence in this case today and have arrived at a conclusion on how the crash occurred," Lt. Kenny Hayes said of the 2:49 p.m. traffic fatality at Ormond Beach Middle School on East Lindenwood Circle.

Here's a synopsis of what happened Wednesday: McKensie Malecki had pulled the pick-up truck she was driving behind another pick-up, but when her 12-year-old brother, Cameron Malecki got in the passenger-side door, he hadn't closed it all the way she "began to pull away," Hayes said. Investigators determined that Mckensie Malecki had in fact parked behind another truck on Lindenwood Circle. Cameron Brennemen got into the truck, but had not fully closed the door when Mckensie began to pull away. Her truck sideswiped the other truck as she pulled away. Investigators believe this may have startled Mckensie and she accidently pushed the accelerator instead of the brake. The truck lurched forward and Cameron was ejected through the open door falling next to the truck and was run over. The truck then crossed the street and struck the concrete pole.

There was no evidence to suggest that Mckensie Malecki was impaired in any way. Investigators have ruled out any criminal charges against her based on the evidence. A decision of whether she will be cited for a traffic violation in connection with the crash will be made at the conclusion of the investigation.
