36. Prosecutor shoots home invader

PONCE INLET -- An appeals prosecutor shot a home invader in the stomach the night of Aug. 26 after he was warned several times to leave the home, according to a police report.
Kenneth Nunnelley the lead prosecutor for appeals to the Florida Supreme Court in the 7th judicial circuit, pointed a 9 mm handgun at Roman Nowak who had pushed his way into the home while he was there with his wife and children about 10:30p.m. that night.

When the 43-year-old intruder refused to leave despite being warned that he would be fired upon -- the prosecutor did just that after asking his wife to call 911, firing a shot directly at the would-be assailant.

The home invader was transported to Halifax Medical Center in Daytona Beach where he was admitted in critical condition, ultimately surviving the wound.

Nunnelley told Ponce Inlet police he was in bed when he was awakened by a knock on the door and Roman yelling: "It's me, Roman. Let me in. You know I was just here." The intruder opened the screen door and as Nunnelley had the front door ajar, he pushed his way through, prompting the shot being fired.

Ponce Inlet police determined Nunnelley, 56, exercised his right to use deadly force to protect his family and property.
