DAYTONA BEACH -- Patrick Henry won the special election for the zone 5 city commission seat tonight that his older brother was forced to vacate because of pending charges that absentee ballots were illegally obtained before last August's primary.

With only 15 percent of eligible voters participating, Henry defeated Mario Hemingway, 490 to 452, according to the unofficial tally of the Volusia County Board of Elections.

Derrick Henry could reclaim his seat if he is acquitted of the charges at trial.
