His wife, Tina Marie Smith, 36, was arrested Dec. 10, on similar child porn charges.

PALM COAST -- Alton Everett Smith, the 46-year-old fugitive from justice apprehended Monday by New Smyrna Beach police and the United States Marshall Service after trying to escape by climbing down six stories from the Oceania Beach Club on the beachside, has now been charged by Flagler County authorities with felony incest with his own daughter, 25-year-old Kristilyn Smith. She, too, was charged today with incest.

The elder Smith was wanted as a fugitive from justice on 37 counts of possessing child pornography, and had been on the run for about a month.

His wife, Tina Marie Smith, 43, was arrested on similar child pornography possession charges Dec. 30. The daughter, not blood-related to her father's wife, has already been charged with adult prostitution and child neglect for allegedly not taking her young son to school, Flagler authorities have said.

The child porn charges stem from a Flagler County Sheriff's investigation into a prostitution ring operated by the daughter from her parents' Palm Coast home, investigators have said. It was during that initial investigation that investigators said they found multiple photos of young children engaging in sex acts.

The authorities have said they are investigating whether some of the photos may have been taken at a Daytona Beach photo shop operated by Alton Everett Smith before it closed a year ago. He is now being held on bail amounts totaling $950,000, while his wife and daughter are jailed on lesser amounts.
