NEW SMYRNA BEACH, Fla. -- Officers with the New Smyrna Beach Police Department arrested 40-year-old Justin Budd Stanley of Edgewater after receiving a report of a suspicious person running around completely naked and actively strange behind a Circle K on State Road 44.
NSBPD investigators also said Stanley appeared to be under the influence of narcotics when he was arrested on July 16. He's remained behind bars since then unable to make his $32,500 bail.
Stanley is scheduled for arraignment before Circuit Judge Kathryn Weston on Aug. 18 at 1:30 p.m.
He was arrested On July 16, 2026, at approximately 4:39 p.m., after NSBPD officers responded to Circle K, located at 1801 SR-44, having received 9-1-1 calls about a suspicious person who was not wearing any clothing and acting strange.
Upon arrival, officers located an adult male behind the business who was nude, behaving erratically, and appeared to be under the influence of narcotics. The individual refused repeated lawful commands and resisted officers' efforts to detain him.
Stanley was arrested and charged with disorderly conduct; three counts of battery on a law enforcement officer;
and two counts of resisting an officer without violence.
The NSB cops who responded were not injured.
The defendant intentionally touched/struck an officer while engaged in the execution of his legal duties, by pushing one officer and kicking another cop twice.
The defendant knowingly and willfully resisted, obstructed or opposed said officer while in the execution of legal and lawful duties without offering or doing violence (pulling away and refusing to obey commands) to said officer.
"The defendant committed the act (of being completely nude) which corrupted public morals, outraged the sense of public decency or affected the peace and quiet of person(s) who witnessed him," one of the cops wrote in his report.
Stanley appeared to be under a altered mental status as he is known for narcotic use. Stanley was given commands to place his hands behind his back due to his behavior, as he kept tensing up while standing and talking about Heaven and walking to the Garden of Eden. Stanley refused to comply with these lawful commands.

Based on the circumstances, one of the officers attempted to detain him, Stanley actively resisted by pushing the cop with both hands. Officers then gained control of Stanley and successfully placed him in handcuffs. He was escorted to the rear seat of a marked patrol vehicle.
While seated inside the vehicle, Stanley repeatedly kicked the plastic window divider that separates the front and rear compartments of my patrol while continuing to display combative behavior.
Stanley was then removed from the patrol vehicle and assisted in putting his pants back on and advised that he was being placed in "The Wrap" restraint system, based on his continuing behavior kicking the plastic divider inside the patrol vehicle in order to prevent any injuries to himself and the officers.
As officers attempted to place Stanley into the restraint system, he began actively resisting. In order to safely gain control, I performed a controlled takedown, which in turn enabled officers to start the process of securing him in "The Wrap."
"Stanley continued resisting and intentionally kicked me twice with both of his legs," an officer documented in the arrest report, adding, "Mr. Stanley was ultimately secured in 'The Wrap' restraint system and placed back into the rear seat of my patrol vehicle."
Stanley was transported to the Volusia County Branch Jail without further incident. The mental health issued box was checked as yes, based on the fact that Stanley was naked and possibly showing signs of altered mental status.
