DELAND, Fla -- Alvin Mortimer, a Deltona resident with a lengthy criminal record who has repeatedly baited County Councilwoman Heather Post in Facebook rants apparently got too close for comfort in confronting her in an aggressive manner during a break in a recent public meeting that convinced a judge earlier today to slap him with a year-long restraining order.
Though domestic-related issues also are a part of his past. But it was his alleged aggressiveness with Post in ramped-up social media postings and in confronting her in her county office during a break after a contentious public citizen segment that was enough to convince a judge earlier today to slap Alvin Lawson Mortimer III (DOB: 3/6/1974) with a year-long restraining order that restricts his movements with respect to Post in her elected duties.
Should Mortimer violate the tenets of the restraining order issued by Circuit Judge Karen Foxman, he could go to jail, even though the restraining order was filed as a civil matter. That's because the intent of the order is to ensure the limits outlined by the judge are explicitly followed to avoid further escalation of intimidation or fear that could lead to danger.
Post put out a statement on her Facebook page, stating, "On a typical day you will find me fighting for the safety of my constituents. Today I had to fight for my own and a permanent stalking injunction was granted against Mr. Mortimer after a hearing."

For his part, Mortimer sent Headline Surfer a text message, stating in part, "I'm muzzled for a year." Mortimer said he felt the decks were stacked against him because Post is an elected county leader and former deputy and her husband, Randy Post, also is a deputy and the assigned firearms instructor assigned at the VCSO's Stephen Saboda Training Center in Daytona Beach. The Posts reside in greater Daytona Beach.
Mortimer argued that the judge bought the "hearsay argument that covered her husband, but not me." However, when pressed to explain why he had gone out of his way to track down Post outside the Frank T. Bruno Jr Council chambers, Mortimer did not respond.
