NEW SMYRNA BEACH -- Roy Deion Fudge Jr., has been sentenced to five years in prison for last May's near-fatal shooting of another New Smyrna Beach man.
Fudge pleaded no contest Dec. 2 to attempted murder and was subsequently sentenced that day by Circuit Judge Frank Marriott at the Volusia County Courthouse in DeLand.
Fudge, a convicted felon even before this case and just 20 years old, will be given 265 days credit for time served while awaiting the disposition of his case, after initially pleading innocent and must serve 85 percent of his sentence so he could be out a year earlier if he behaves while doing his time.
Three days after the shooting, New Smyrna Beach police obtained an arrest warrant for the apprehension of Fudge in the shooting of Marcus Peterson in the 500 block of Josie St. The warrant specified that Fudge was considered armed and dangerous and should not be detained without backup. He was apprehended a short time later without incident.
The 37-year-old Peterson was shot at least once, about a block from Ronnoc Lane. Police responding to the 6:34 p.m. shooting, found the bleeding victim, police Sgt. Valerie Joyce said. He underwent surgery for a gunshot wound to his left shin at Bert Fish Medical Center.
